Ohio Issue #2: Legalization of Recreational Marijuana

The passing of Issue #2 does not mean that employees can now use marijuana.

As employers, we are still able to create hiring and employment policies related to marijuana use.  All employees who are collectively bargained to the Union Construction Industry Substance Abuse Program are and will be bound to the policy. 

Marijuana will not be allowed in our program for the following reasons:

  • Marijuana is illegal federally and is considered a Class 1 narcotic.
  • The Ohio Bureau of Workers Compensation Drug-Free Safety Program is based on the U.S. Department of Transportation’s drug testing panel, which requires testing for marijuana.
  • The State of Ohio requires testing for marijuana on public jobs.
  • A medical marijuana Card does not allow employees to have marijuana in our program.

Please inform employees that if they use marijuana, it will count as a positive drug test in our program!
